Residential Real Estate Transactions

Our firm has been representing clients in residential real estate transactions since its inception in 1980. Representing clients in residential real estate transactions is a principal area of our practice. Some of our staff do almost nothing else. We have the knowledge and experience needed to guide you in what very well may be the largest financial transaction of your life.

What can you expect from us? If you are a Seller, you can expect the following services:

  1. Advice concerning the consequences of your Contract;
  2. Review of your Contract and preparation of an Attorney Modification Letter, if applicable;
  3. Review of your Buyer's Attorney Modification Letter and recommendations as to responses;
  4. Review of your Buyer's Inspection demands and recommendations as to responses;
  5. Negotiation of the Attorney Modification and Inspection issues;
  6. Ordering of Title Insurance;
  7. Ordering of Survey, if applicable;
  8. Ordering of Homeowners' Association letter and documents, if applicable;
  9. Ordering of mortgage payoff letters, if applicable;
  10. Preparation of the Closing Documents, including the Warranty Deed, Affidavit of Title, Bill of Sale, ALTA Statements, Revenue Declarations, as applicable, and title insurance documents as applicable;
  11. Preparation of the Seller Closing Statement;
  12. Setting the place and time of closing; and
  13. Attendance at Closing.

We will quote you a flat fee when we are retained. The fee will not change unless extraordinary matters arise. Extraordinary matters might include the preparation of easement or license agreements or other nonstandard documents, clearing of unanticipated title objections, appearance in court, problems causing a prolonged closing, and matters arising subsequent to closing. We will advise when extraordinary matters arise, discuss what needs to be done, and come to agreement with you on a revised fee arrangement.

If you desire not to attend the Closing or, if you will be unable to attend the Closing due to your work obligations, etc., we will arrange it so that you do not have to attend. We will have you sign required documents and a power of attorney in advance of Closing.

If you are a Buyer you can expect the following services:

  1. Advice concerning the consequences of your Contract;
  2. Review of your Contract and preparation of an Attorney Modification Letter;
  3. Review of your Inspection Report and preparation of a Inspection Demand Letter;
  4. Negotiation of the Attorney Modification and Inspection issues;
  5. Monitoring of the Financing Contingency and preparation of extension requests, if required;
  6. Setting the place and time of Closing;
  7. Review of the Title Commitment to make certain that you are obtaining good and marketable title, and the appropriate title insurance coverage;
  8. Review of the closing figures to make certain of their accuracy and that you are not over paying and are receiving the appropriate credits;
  9. Instruction as to what you must bring to Closing, which will include the amount of funds needed to Close, whether the funds must be wired or can be in the form of a cashier's check, a hazard insurance policy and paid receipt, and a driver's license or state identification card.
  10. Attendance at Closing;
  11. Review and explanation of your financing;
  12. Examination of the Closing documents to make certain they are correct and you receive good and marketable title; and;
  13. Follow up after Closing to make certain you receive an Owners Title Insurance Policy and the recorded Warranty Deed.

Again, we will quote you a flat fee when we are retained, and the quoted fee will not change unless extraordinary matters arise. If extraordinary matters do arise, we will promptly advise you of the same, discuss what needs to be done, and come to an agreement on an altered fee arrangement.
